1. Introduction
   Welcome to Zingka.
   These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and CyberBlaze Limited (“Company,” “we,” “us,” or “our”) regarding your access to and use of our websites, mobile applications, software, content, features, virtual goods, and related services (collectively, the “Services”).
   The Services are designed to provide interest-based communities, community interaction, profile discovery, messaging, personalized recommendations, content sharing, and other social and community-based features.
   These Terms are supplemented by our Privacy Policy, Community Guidelines, Purchase and Payment Agreement, Refund Policy and any other policies or terms that expressly apply to particular features of the Services.
   Please read these Terms carefully before accessing or using the Services.
   By accessing, downloading, registering for, or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the applicable policies referenced above.
   If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility
   To access or use the Services, you must be at least eighteen (18) years old and legally capable of entering into a binding agreement under applicable law.
   By accessing or using the Services, you represent and warrant that:

• You are at least 18 years of age;

• You have the legal authority and capacity to agree to these Terms;

• Your use of the Services does not violate any applicable law or regulation;

• You have not previously been permanently removed from the Services, unless we expressly permit you to return;

• All information you provide to us is accurate, truthful, and current.
  The Services are intended solely for adults. We do not knowingly permit individuals under the age of 18 to create accounts or use the Services.
  We reserve the right to refuse access to the Services, suspend or restrict accounts, request age or identity verification, or terminate accounts where we reasonably believe that a user does not meet the eligibility requirements or presents safety, legal, security, or compliance risks.

3. Account Registration and Security
   Certain features of the Services may require you to create an account.
   When registering for an account, you agree to provide accurate, complete, and up-to-date information and to keep such information updated.
   You are responsible for maintaining the confidentiality and security of your account credentials, including your username, password, verification codes, and any linked third-party login methods.
   You are responsible for activities conducted through your account to the extent permitted by applicable law.
   You agree that you will not:

• Create accounts using false, misleading, or fraudulent information;

• Impersonate any individual or entity;

• Create multiple accounts for abusive, deceptive, fraudulent, or manipulative purposes;

• Sell, transfer, lease, or share your account with another person without authorization;

• Access another user’s account without authorization;

• Use bots, scripts, crawlers, or other unauthorized automated systems to register accounts or access the Services.
  We may reclaim usernames, restrict accounts, require identity or age verification, suspend accounts, or terminate accounts where reasonably necessary to enforce these Terms or protect the Services and our users.
  If you believe your account has been compromised or accessed without authorization, you should notify us promptly.

4. Description of the Services
   The Services may include:

• Interest-based communities or communities;

• Community feeds and user-generated posts;

• Profile discovery and user recommendations;

• Messaging and other communication tools;

• User profiles, photos, and other profile content;

• Virtual items and digital products;

• Location-based content, Personalized community, or member recommendations;

• Memberships or subscription features;

• Content promotion or additional visibility features;

• Other community and social features made available through the App.
  The availability and functionality of specific features may vary depending on your account, subscription status, device, country or region, or version of the Services.
  You acknowledge that the Services are provided for communication, community participation, social interaction, discovery, and entertainment purposes.
  We do not guarantee:

• Compatibility between users;

• That you will establish a friendship, relationship, or other social connection;

• That another user will respond to your messages or interactions;

• Any particular amount of engagement, visibility, popularity, or response;

• The authenticity, accuracy, or completeness of user-generated content;

• That another user will behave consistently with their profile, statements, or representations;

• That a recommended user, community, post, or other recommendation will be suitable for you.
  You are responsible for your communications, interactions, and relationships with other users, both online and offline.
  We may modify, update, suspend, limit, replace, or discontinue particular features of the Services where reasonably necessary for product, technical, security, legal, compliance, or operational reasons.

5. User Content
   The Services may allow users to submit, publish, upload, transmit, display, or otherwise share content, including but not limited to:

• Posts;

• Comments;

• Text;

• Images;

• Photos;

• Profile information;

• Usernames;

• Messages;

• Community content;

• Other materials made available through the Services.
  Such materials are collectively referred to as “User Content.”
  You retain any ownership rights that you lawfully hold in your User Content.
  By posting or submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, distribute, format, modify, adapt, moderate, analyze, and otherwise use such User Content as reasonably necessary to:

• Operate and provide the Services;

• Display your content to other users as intended by the relevant feature;

• Maintain, secure, and improve the Services;

• Moderate content and enforce our policies;

• Promote the Services where permitted by your settings and applicable law;

• Comply with applicable legal obligations.
  You acknowledge and agree that:

• User Content may be visible to other users depending on the relevant feature and your privacy settings;

• We may review, moderate, restrict, remove, or refuse User Content where permitted by applicable law;

• We are not obligated to monitor all User Content;

• You are responsible for the User Content you submit and the consequences of publishing or sharing it.
  You represent and warrant that:

• You own or have all necessary rights and permissions to submit the User Content;

• Your User Content does not violate applicable law or third-party rights;

• Your User Content does not violate these Terms or our Community Guidelines.
  We may remove or restrict User Content that violates these Terms, our Community Guidelines, applicable law, or the rights or safety of others.

6. Moderation and Enforcement
   We may use automated systems, human moderators, or a combination of both to review, detect, moderate, restrict, or remove content or activity that may violate our rules or create safety, legal, security, or compliance risks.
   We may take actions including:

• Removing or restricting User Content;

• Limiting content visibility or distribution;

• Restricting messaging, posting, or interaction features;

• Issuing warnings;

• Applying temporary restrictions;

• Suspending or terminating accounts;

• Requesting age, identity, or account verification;

• Reporting unlawful activities to relevant authorities where required by law.
  We may take such action where we reasonably believe that a user, account, content, or activity:

• Violates these Terms, our Community Guidelines, or applicable law;

• Creates safety, security, legal, or compliance risks;

• Harasses, deceives, abuses, threatens, or harms another user;

• Involves spam, fraud, fake accounts, impersonation, or manipulation;

• Interferes with the normal operation or integrity of the Services.
  Automated or human moderation may not identify every violation, and moderation systems may occasionally make errors.
  We do not guarantee that all prohibited content or conduct will be identified, reviewed, or removed immediately.
  Where reasonably necessary to protect users, the Services, or the public, we may take enforcement action without prior notice.

7. Messaging and User Interactions
   The Services may allow users to communicate and interact through community features, comments, messaging tools, profiles, and other interactive features.
   You acknowledge that:

• Users may provide inaccurate, misleading, offensive, inappropriate, or fraudulent information;

• Online interactions involve inherent risks;

• We do not independently verify the identity, background, intentions, or statements of every user;

• We do not conduct criminal background checks on every user;

• A recommendation, community membership, profile display, online indicator, or other product feature does not constitute an endorsement or safety guarantee.
  You are responsible for exercising reasonable caution and judgment when communicating or interacting with other users.
  This includes when you choose to:

• Share personal information;

• Communicate outside the Services;

• Send money or enter into a transaction;

• Meet another user in person.
  The Company does not guarantee or assume responsibility for:

• Any user relationship or interaction;

• The accuracy or reliability of another user’s profile or statements;

• Any meeting, transaction, or communication between users;

• The conduct of users outside the Services;

• Any particular community or social outcome.
  We encourage you to use available safety features, including reporting, blocking, privacy controls, and other account safety tools where appropriate.

8. Intellectual Property Rights
   The Services and all content provided by or on behalf of the Company, including software, source code, algorithms, interfaces, designs, layouts, graphics, logos, trademarks, icons, visual elements, audio materials, videos, features, databases, technology, and other proprietary materials (“Platform Content”), are owned by or licensed to the Company and are protected by applicable intellectual property laws.
   Except as expressly permitted under these Terms, you may not:

• Copy, reproduce, distribute, publish, transmit, display, modify, or create derivative works from the Services or Platform Content;

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Services, except where applicable law expressly permits;

• Use the Company’s name, trademarks, logos, branding, or visual identity without authorization;

• Exploit the Services or Platform Content for unauthorized commercial purposes;

• Remove, obscure, or alter copyright, trademark, or proprietary notices.
  Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal purposes in accordance with these Terms.
  Nothing in these Terms transfers ownership of the Services or the Company’s intellectual property to you.
  Any feedback, suggestions, or ideas you voluntarily submit regarding the Services may be used by the Company without compensation, subject to applicable law.

9. Purchases, Subscriptions, and Payments
   Certain features of the Services may require payment or may be offered through subscriptions, memberships, digital goods, virtual items, content promotion, additional visibility, or other paid products.
   The specific price, duration, billing period, included benefits, renewal terms, and other applicable conditions will be displayed before you complete a purchase.
   Purchases made through the Apple App Store, Google Play, or another third-party payment platform are also subject to the applicable platform’s payment terms and policies.
   Auto-renewable subscriptions will continue to renew until cancelled in accordance with the applicable payment platform’s procedures.
   Subscription prices may change from time to time. Any price adjustment, notice, consent requirement, and effective date will be handled in accordance with applicable law and the rules of the applicable payment platform.
   Deleting the App or deleting your account does not necessarily cancel an active subscription. You are responsible for cancelling an active subscription through the applicable payment platform.
   All purchases, subscriptions, billing matters, subscription price changes, and paid product rules are further governed by our Purchase and Payment Agreement.
   Refunds are separately governed by our Refund Policy, the rules of the applicable payment platform, and applicable law.
   Cancellation of a subscription and a request for a refund are separate actions.

10. Disclaimer of Warranties
    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
    THE COMPANY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, TO THE EXTENT PERMITTED BY LAW, WARRANTIES OF:

• MERCHANTABILITY;

• FITNESS FOR A PARTICULAR PURPOSE;

• NON-INFRINGEMENT;

• ACCURACY;

• RELIABILITY;

• SECURITY;

• AVAILABILITY;

• UNINTERRUPTED OR ERROR-FREE OPERATION.
  WE DO NOT GUARANTEE THAT:

• THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, OR UNINTERRUPTED;

• USER CONTENT WILL ALWAYS BE ACCURATE, RELIABLE, AUTHENTIC, OR APPROPRIATE;

• ANOTHER USER WILL RESPOND TO YOUR MESSAGE OR INTERACTION;

• ANY PARTICULAR FRIENDSHIP, RELATIONSHIP, CONNECTION, OR SOCIAL OUTCOME WILL RESULT FROM USE OF THE SERVICES;

• ANY RECOMMENDATION WILL BE ACCURATE OR SUITABLE FOR YOU;

• THE SERVICES WILL BE FREE FROM TECHNICAL ISSUES, SECURITY INCIDENTS, OR OTHER ERRORS.
  THE COMPANY DOES NOT GUARANTEE THE IDENTITY, INTENTIONS, LEGITIMACY, BEHAVIOR, OR TRUSTWORTHINESS OF ANY USER.
  NO INFORMATION, CONTENT, RECOMMENDATION, OR COMMUNICATION PROVIDED THROUGH THE SERVICES CREATES A WARRANTY THAT IS NOT EXPRESSLY STATED IN THESE TERMS.
  Nothing in this section excludes any warranty or consumer right that cannot legally be excluded.

11. Limitation of Liability
    To the maximum extent permitted by applicable law, the Company, its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to, use of, or inability to use the Services.
    This includes, without limitation, losses arising from:

• User Content;

• The conduct, statements, actions, omissions, or interactions of another user;

• Any friendship, relationship, conversation, connection, meeting, disagreement, misunderstanding, or other social outcome;

• Inaccurate, misleading, offensive, harmful, or unlawful content;

• Unauthorized access to or use of your account, content, or information;

• Service interruptions, technical errors, delays, security incidents, data loss, or system failures;

• Purchases, subscriptions, virtual items, or other paid features;

• Decisions you make based on content, profiles, recommendations, or information available through the Services;

• Offline meetings, communications, transactions, or interactions between users.
  The Services provide a platform for interest-based communities, community interaction, discovery, communication, and social interaction.
  The Company does not control or guarantee the behavior, intentions, identity, compatibility, truthfulness, or reliability of users.
  Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited only to the maximum extent permitted by applicable law.
  Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

12. Suspension and Termination
    We may suspend, restrict, disable, or terminate your access to all or part of the Services where we reasonably believe that:

• You have violated these Terms, our Community Guidelines, or applicable law;

• Your conduct creates legal, security, safety, fraud, compliance, reputational, or operational risks;

• You engage in harassment, fraud, spam, deception, abuse, impersonation, or other prohibited conduct;

• Your account is associated with fake identities, unauthorized automation, suspicious activity, or manipulation of the Services;

• Continued access may harm the integrity, safety, or normal operation of the Services.
  We may also remove, disable, restrict, or delete User Content associated with suspended or terminated accounts where permitted by applicable law.
  You may stop using the Services or delete your account at any time, subject to any outstanding obligations.
  Deleting your account does not automatically cancel any subscription purchased through a third-party payment platform.
  Suspension or termination may result in:

• Loss of access to your account;

• Loss of access to certain User Content;

• Removal of profile information or other materials;

• Loss of access to virtual items or digital entitlements where permitted by applicable law and the applicable payment terms.
  Any provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitation of liability, dispute resolution, and applicable law.

13. Governing Law and Dispute Resolution
    These Terms and any disputes, claims, or controversies arising out of or relating to the Services, these Terms, or the relationship between you and the Company will be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles, except where applicable law requires otherwise.
    The parties should first attempt to resolve any dispute arising out of or relating to these Terms or the Services through good-faith discussions.
    If a dispute cannot be resolved through such discussions within a reasonable period, it may be submitted to the competent courts of Hong Kong, except where applicable consumer or other mandatory law provides you with the right to bring a claim in another jurisdiction.
    To the extent permitted by applicable law, claims relating to the Services should be brought on an individual basis rather than as part of a class, collective, or representative proceeding.
    Any waiver of class, collective, representative, or similar proceedings applies only to the extent permitted by applicable law.
    Nothing in these Terms prevents either party from seeking injunctive, equitable, or other appropriate legal relief where permitted by law.
    If any provision of this section is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

14. Changes to These Terms
    We may update these Terms from time to time to reflect changes in:

• The Services;

• Product features;

• Our business practices;

• Applicable law or regulatory requirements;

• Safety or security requirements;

• Related policies.
  If we make material changes, we will provide notice where required by applicable law.
  Notice may be provided through the Services, account notifications, email, or other reasonable means.
  Unless otherwise stated, an updated version of these Terms will become effective on the effective date specified in the updated Terms.
  Where applicable law requires your express consent to a material change, the relevant change will not apply to you until the required consent has been obtained.
  Where express consent is not required, your continued use of the Services after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
  If you do not agree to the updated Terms, you should stop using the Services.

15. Relationship With Other Policies
    These Terms form the general agreement governing your use of the Services.
    Certain features and activities are subject to additional policies, including:

• Privacy Policy — governs how personal information is collected, used, stored, and otherwise processed;

• Community Guidelines — governs acceptable and prohibited user behavior and content;

• Purchase and Payment Agreement — governs purchases, subscriptions, billing, digital products, and other paid features;

• Refund Policy — governs refund requests and refund eligibility;
  If an additional policy specifically governs a particular feature or transaction, that policy will apply to that matter together with these Terms.
  If there is any conflict between these Terms and the Privacy Policy, the Privacy Policy will govern with respect to personal data, and these Terms will govern with respect to ownership of and intellectual property licenses relating to User Content.
